By using the Site or buying from us you agree to these terms. If you do not agree, please do not use the Site. These terms are between you and The Texas Honeybees Baton Twirling d/b/a Baton Twirling 101.

Who may use the Site

You must be at least 18 years old, or the age of majority where you live, to create an account or make a purchase. A parent or legal guardian must create the account, make the purchase, and supervise any participation by a minor. You are responsible for everything that happens under your account, and you agree to keep your password confidential and tell us promptly if you suspect unauthorized use.

What you're buying

  • Online courses and lessons: an ongoing personal license to stream the content while your purchase or membership remains active.
  • Digital downloads: a personal license to download and use the files for yourself, your own child, or your own students where the product says so.
  • Membership: recurring access to included content for as long as your subscription is active.
  • Private lessons: a scheduled one-to-one session delivered over video conferencing.
  • Physical products: goods shipped to the address you provide at checkout.

Content license and restrictions

All course videos, written lessons, downloads, images, and branding on the Site are owned by us or our instructors and are protected by copyright. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use them for your own training or coaching, as described on the product page.

  • Do not share your account credentials or let others use your access.
  • Do not copy, resell, sublicense, re-upload, or publicly perform our content.
  • Do not download, screen-record, or redistribute streaming videos.
  • Do not use our content to build a competing course or training product.
  • Do not remove copyright notices or watermarks.

Instructor-uploaded content

Instructors who upload material to the Site keep ownership of what they upload and grant us a license to host, display, and deliver it to enrolled students. Instructors confirm they hold all rights to what they upload, including music and imagery, and that it does not infringe anyone else's rights. We may remove content that violates these terms or our DMCA policy.

Pricing, payment, and taxes

Prices are shown in US dollars and may change at any time, though a change never affects an order already placed. By purchasing you authorize us and our payment processor to charge the payment method you provide for the total shown at checkout, including any shipping and applicable tax. If a payment fails, we may suspend access until it is resolved. We correct obvious pricing errors and will contact you before charging a corrected amount.

Subscriptions and auto-renewal

Memberships and other subscription plans renew automatically at the interval and price shown at checkout — monthly plans renew monthly, annual plans renew annually — until you cancel. Your card is charged at the start of each billing period. You can cancel any time from your account or by emailing us; cancellation stops the next renewal and you keep access through the end of the period you already paid for. Except where the law requires otherwise, partial periods are not refunded.

Order bumps and post-purchase offers

Some checkouts offer optional add-ons before you pay, or one-click offers immediately after you pay. Add-ons are only charged if you select them. A one-click offer charges the payment method you just used, at the price shown on that offer, when you accept it. Declining costs nothing and does not affect your original order.

Coupons and promotions

Coupon codes may be limited to particular products, quantities, or dates, may not be combined unless we say so, hold no cash value, and may be withdrawn at any time. We may void a discount obtained through misuse or fraud.

Refunds

Our Refund Policy is part of these terms. Please read it before you buy.

Acceptable use

  • Do not interfere with, probe, or overload the Site or its infrastructure.
  • Do not attempt to access accounts, data, or areas you are not authorized to use.
  • Do not upload malware, spam, or unlawful, harassing, or infringing material.
  • Do not scrape or bulk-download the Site or use it to train machine-learning models without written permission.
  • Do not misrepresent your identity or your relationship with us.

Termination

We may suspend or close an account that breaches these terms, that we reasonably believe is being used fraudulently, or where required by law. If we close your account without cause, we will refund any unused prepaid period. You may close your account at any time by emailing us.

Baton twirling is a physical activity that carries a risk of injury. Our instruction is educational and is not medical advice. See our Physical Activity Disclaimer, which forms part of these terms.

Disclaimer of warranties

The Site and everything on it are provided "as is" and "as available". To the fullest extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted or error-free, and we make no promise about any particular skill, competitive result, or outcome from following our instruction.

Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Site or our products. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim arose. Some states do not allow certain limitations, so parts of this section may not apply to you.

Indemnity

You agree to indemnify and hold us harmless from claims, losses, and reasonable legal fees arising out of your misuse of the Site, your breach of these terms, or your infringement of someone else's rights.

Governing law and disputes

These terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Texas, and you and we consent to that jurisdiction. Nothing here prevents either of us from bringing a claim in small claims court. We would much rather sort things out directly, so please email us first.

Changes and contact

We may update these terms; the date at the top of the page shows when. Continuing to use the Site after a change means you accept the updated terms.
